1. Agreement to Terms

By accessing or using BuzzCreen ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

BuzzCreen provides:

• Screen Recording: Chrome extension for capturing screen, webcam, and audio
• Video Editing: Web-based editor with timeline, effects, and automatic zoom generation
• Video Rendering: Cloud-based video processing and export
• Video Storage: Secure storage and CDN delivery of your content
• Video Sharing: Public and private sharing capabilities

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You must be at least 13 years old to use this Service
• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account

3.2 Account Termination

You may terminate your account at any time through your dashboard settings. Upon termination:

• All your videos and projects will be permanently deleted
• Your subscription will be cancelled (no refund for unused time)
• Shared video links will stop working
• Your personal data will be deleted within 30 days (as per GDPR)

4. Subscription Plans and Billing

4.1 Plans

BuzzCreen offers multiple subscription tiers with different limits and features. Current plans are available at buzzcreen.com/pricing.

4.2 Billing

• Subscriptions are billed monthly or annually in advance
• All payments are processed securely through Stripe
• Prices are in USD unless otherwise stated
• EU customers: VAT/IVA will be added as applicable (21% in Spain)
• Automatic renewal unless cancelled before the next billing cycle

4.3 Refund Policy

14-Day Money-Back Guarantee (EU Right of Withdrawal):

• EU customers have 14 days from purchase to request a full refund
• No questions asked, full refund guaranteed
• Contact support@buzzcreen.com to request a refund
• Refunds processed within 5-10 business days

After 14 days: No refunds for unused subscription time. You can cancel anytime to prevent future charges.

4.4 Cancellation

You can cancel your subscription anytime through your dashboard or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period.

5. Usage Limits and Fair Use

5.1 Plan Limits

Each subscription plan has specific limits on:

• Monthly rendering minutes
• Total storage space
• Number of shared videos
• Video resolution and quality

5.2 Fair Use Policy

We expect all users to use the Service in good faith. Prohibited activities include:

• Using the Service for illegal purposes
• Attempting to abuse, exploit, or circumvent usage limits
• Sharing accounts between multiple users
• Automated/bot usage without permission
• Uploading malware, viruses, or harmful code
• Creating excessive load on our systems

6. Content Ownership and Rights

6.1 Your Content

You retain all ownership rights to the videos, recordings, and content you create using BuzzCreen.

6.2 License to Us

You grant BuzzCreen a limited, worldwide, non-exclusive license to:

• Store your content on our servers
• Process and render your videos
• Deliver your content via CDN when you share it
• Create backups for data integrity

We will NOT:

• Use your content for marketing without explicit permission
• Sell or share your content with third parties
• Train AI models on your content
• Claim any ownership of your content

6.3 Content Responsibility

You are solely responsible for your content and must ensure:

• You have the rights to all content you upload
• Your content doesn't violate copyrights, trademarks, or intellectual property
• Your content doesn't contain illegal material
• Your content doesn't violate anyone's privacy or rights

7. Prohibited Content

You may not upload, share, or create content that contains:

• Illegal activities or content
• Child sexual abuse material (CSAM) - zero tolerance, immediately reported to authorities
• Terrorism, extremism, or violence
• Hate speech, harassment, or discrimination
• Pornographic or sexually explicit material
• Spam, phishing, or malware
• Copyright infringement
• Personal information of others without consent

Violation will result in: Immediate account termination, content deletion, and potential legal action.

8. Data Protection and Privacy (GDPR)

As a service processing data of EU citizens, we comply fully with GDPR (General Data Protection Regulation).

8.1 Your GDPR Rights

• Right to Access: Request a copy of your personal data
• Right to Rectification: Correct inaccurate data
• Right to Erasure: Delete your account and all associated data
• Right to Data Portability: Export your videos and data

9. Service Availability

9.1 Uptime

We strive to provide 99.9% uptime but do not guarantee uninterrupted access. Planned maintenance will be announced in advance when possible.

9.2 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice. We will make reasonable efforts to notify users of significant changes.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for any data loss (though we maintain backups)
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the last 12 months

EU Consumer Rights: Nothing in these Terms limits your statutory rights as an EU consumer.

11.3 Governing Law

These Terms are governed by Spanish law. EU consumers retain the protection of mandatory consumer laws in their country of residence.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be effective:

• 30 days after posting for material changes
• Immediately for minor corrections or clarifications

We will notify you via email or prominent notice on the website for material changes. Continued use after changes means you accept the new Terms.
